The Website and the App will be jointly referred to as the “Platform”. Please read these Terms and Conditions carefully before you avail of our services.

If you do not agree to these Terms and Conditions by Travel Diaries Group (henceforth referred to as “we/us/our”) , you may not continue to use the services on the Platform. By downloading, installing, or even merely using the Platform, you will signify your acceptance of this document containing the Terms and Conditions and other policies (including but not limited to the Cancellation Policy and Privacy Policy) as posted on the Platform and amended from time to time. Your use of the aforementioned Platform will be at your own risk, and we reserve the right to amendment, without any prior notice.

Those who choose to access the Platform from locations where the use is prohibited or banned, do so at their own risk and are solely responsible for compliance with these laws by local authorities, to the extent these laws are applicable and if they are applicable. We will not be held liable for any account for the aforementioned prohibited usage.

LIMITATION ON CONTENT USE

The use of materials and information on the Platform is at your own risk, entirely, and we will not undertake any liability for unauthorized usage. It will be your responsibility to ensure the services, products, and information available on the Platform meet your needs and requirements.

All intellectual property rights of the Platform and us, including but not limited to names, logos, text, sound recordings, themes, service marks, images, concepts, or copyrights, are exclusively owned by us. Any reproduction, alternation, or other uses in whole or in part in any manner is strictly prohibited and is deemed a punishable offense.

You may print or download copies of any page(s) from the Platform for your personal reference. However, you must not alter these papers or digital copies in any way. Without obtaining a prior license, you may not use any part of the information, or materials on the Platform, for commercial purposes.

If you print, download or copy any part of the Platform in breach of this section of the Terms and Conditions, your right to use the Platform and its services will cease immediately, and you will be subjected to legal action. At your sole discretion, you must return or destroy any copies that violate these rules.

The Platform may contain materials that are either licensed to or owned by us. This material includes, but is not limited to the layout, appearance, graphics, design, and look of the content displayed on the Platform.

From time to time, the Platform may include links to third-party websites, for your convenience, and to provide more useful insights and/or information. The links do not imply that we endorse the website (s).

We, including our agents, owners, employees, and contractors are not responsible or liable for the content or policies of these websites to which our Platform has links to, or uses offers. It shall be your responsibility to refer to the Terms and Conditions of these third-party websites as well, before availing of our, or their services.

LIMITATION OF LIABILITY

By making, and proceeding to confirm a booking on our Platform, you understand that we merely provide a technology platform, to book services and other related products. The ultimate liability for the execution and performance of the service will rest on the respective Service Provider, and/or Travel Agent, and not on us. So, ultimately, the contract of service is between you, and the aforementioned Service Provider, and/or Travel Agent, as the case dictates.

With respect to this, you acknowledge the following:

We shall assume no responsibility or liability for the standard of services as provided by the respective Service Providers.
We shall not guarantee their quality or fitness as represented at the time of booking, and thereon.
We shall not guarantee the availability of any service that has been listed by these Service Providers.

We, and our subsidiaries, directors, employees, agents, and affiliates, and their respective staff, will not be held liable on any account for any loss that you may suffer due to hotel cancellation policies, visa denial, or cancellation or enforcement of any policy provided by third-party Service Providers, who are associated with the product you purchase from the Platform.

It is your sole obligation to ensure your passport’s eligibility, and validity before undertaking international travel. We, and our subsidiaries, directors, employees, agents, and affiliates, and their respective staff, will not be held liable for your passport being declared ineligible for entry and/or exit, either during or before your international travel. With respect to this, the following are certain essential checkpoints for your passport;

It is mandatory for passports to be valid for a minimum of six months, from the date of return.
Hand-written passports are deemed invalid.
All passports must contain a barcode.
Passports that have been tampered with, or damaged, will not be accepted.
The name on the passport must match the one given on all other official documents that have been submitted for obtaining the visa.

TRANSACTION PRIVITY

By agreeing to these terms and conditions, you acknowledge that this Platform has been made available to you for the purpose of the meeting, and interacting with concerned Service Providers, and other agents to organize your travel requirements. We are not, and will not be a party to, or control any transaction between you and such Service Providers. Therefore, kindly note the following:

All commercial and/or contractual terms have been offered to you by and agreed with between you and the aforementioned Service Providers alone. This includes, and is not limited to terms relating to price, date, period, payment methods, payment terms, warranties, and mode of delivery related to all services, products, or after-sales services. We do not control, determine or advise, or are in any way involved in the offering or acceptance of such commercial terms between you and the Service Providers.

You acknowledge that through the Platform, we merely provide a platform that enables you to have access to various travel services offered by the travel agents or providers. The contract for the sale of any of the products or services that have been agreed to shall be a strictly bipartite contract between you and the service provider, and we shall not be privy to it.

We, and our subsidiaries, directors, employees, agents, and affiliates, and their respective staff will not be responsible or be liable for any direct, incidental, indirect, punitive, special, or consequential damages whatsoever, including without limitation, damages incurred due to loss of use, profits, or data, that may arise out of, or is connected to the use and performance of this Platform. The same applies to any dearth or deficiency of services provided by any third party you may hire, appoint, or encounter, such as tour operators, airlines, hotels, or any similar agency, that directly result from the information available on The Platform.

We do not make any representation or provide any warranty as to the item-specifics, including but not limited to legal title, identity, authenticity, or creditworthiness, of any Service Providers or other agents. You are advised to personally verify the documents of any particular agent or third party that you choose on the Platform, and use your best judgment with regard to the authenticity of the documents.

We shall not be liable for delays or lack of performance, in whole or in part of our obligations due to any cause that is not due to acts or omissions, see Force Majeure Events, and are beyond our reasonable control.

PRIVACY
Your privacy is of the utmost importance to us, thereby, if you choose to accept these Terms and Conditions, you automatically confirm that you have read, understood, and unequivocally accepted the terms in our Privacy Policy.

REFUNDS AND CANCELLATION

You acknowledge, accept and understand that the refund will be credited to you in the form of a cheque drafted under the name of the person, under whom the booking was made. Requests to remit the refund amount, if any, to the account of any third party, will not be considered.

We will also not consider any requests for remittance in the mode of cash, as this goes against our company’s policies. Please view our Cancellation Policy for further information. We reserve the right to hold or forfeit the refund amount if any if a customer is found in violation of any of these terms and conditions.

BOOKINGS, CANCELLATIONS, AND REFUNDS PERTAINING TO COVID-19

As a customer, you agree that due to the ongoing COVID-19 pandemic, there may be circumstances where, the end Service Provider or Travel Agent, either cancels your booking or doesn’t provide the services, as agreed to earlier, irrespective of whether or not a reason has been provided for the same. These reasons may extend to circumstances where or if the customer:

Is exhibiting any known symptoms that have been associated with COVID-19.
Refuses to follow travel and safety advisories, such as wearing protective gear, or refuses to comply with social distancing regulations.
Suffers from any ailment that may make him/her more susceptible to being infected.
Poses to be a threat to the safety or health of other members of the group, or the agents.
Fails to comply with any other condition that has been put forth by the statutory bodies, Central, or State Governments.

In these circumstances, we will neither share, nor assume any responsibility for the refusal of service by the regulatory authorities, nor the end Service Provider. You also acknowledge that the refund, if any, pertaining to these bookings, will only be processed to you, once we receive the same from the Service Provider.

You also acknowledge and accept that due to the uncertainty associated with the COVID-19 pandemic, there may be several, frequent changes in the SOPs and/or travel or safety guidelines issued by the statutory bodies or governments of both the ports of departure or travel destination, which you’ll be required to follow, in order to continue travel.

In the event that you fail to adhere to the norms set forth by official authorities, which ultimately equates to the refusal to travel, we will not be held accountable or liable for the refusal. The refund, if any, will be credited solely at the discretion of the Service Provider.

CUSTOMER RESPONSIBILITY

Though we appreciate hearing from you, you will be held fully responsible for the content of your submissions, on platforms that may include, but aren’t limited to reviews that you post about the Platform, on any other website, social media, or any other mode as may be available. You will refrain from posting or continuing to post, transmit, publish any content about Us, or our subsidiaries, or affiliates, that is unlawful, defamatory, obscene, untrue, threatening, rebellious, pornographic, or other material or content, that you have reason to believe may be untrue, and may have adverse implications on Our reputation.

FORCE MAJEURE EVENTS

Neither we nor any of our subsidiaries, directors, employees, agents, and affiliates, and their respective staff shall be held accountable or be deemed to be in the wrong, on account of any failure to perform, delay, or underperformance of any of our agreed-upon obligations, hereunder, in part, or in whole, if these are rendered impractical, or impossible, by the occurrence of unavoidable, unforeseen circumstances, that may include but aren’t limited to, acts of war or terrorism, strikes, acts of God, natural calamities such as earthquakes, floods, cyclones, or other catastrophes, government, court or administrative orders, epidemics, fire, quarantine restrictions, and other causes that are beyond our scope of control.

Both you, and we will use our best efforts to overcome, avoid, or offset the effects of any resultant or potential cause of any Force Majeure Event. Upon the cessation of the cause of these events, the Terms and Conditions mentioned hereunder will once again be fully operative. However, this category does not relieve you, or us, of any obligations that have taken place before the occurrence of Force Majeure events.
